Are Online Medical Certificates Legal and Valid in Australia?

Yes. Medical certificates issued by an AHPRA-registered doctor following a genuine telehealth consultation are legally valid across Australia. They carry the same legal standing as a certificate issued during an in-person clinic visit.

Under the Fair Work Act 2009, employers are entitled to request evidence that would “satisfy a reasonable person” of genuine illness or incapacity. A medical certificate from a registered GP  whether issued in-person or via telehealth meets this standard, provided it contains the required information.

What Must Be on a Valid Australian Medical Certificate?

In line with the Australian Medical Association (AMA) guidelines and the requirements of the Fair Work Act, a valid medical certificate must include:

  • The full name and AHPRA registration number of the issuing doctor
  • The doctor’s provider number and practice contact details
  • The date of the consultation (the issue date)
  • A statement that you were assessed and are unfit for work, study, or your usual activities
  • The period of incapacity – the dates your absence is covered
  • The doctor’s signature (digital signatures are accepted for telehealth-issued certificates)

Your certificate does not need to include – and your doctor is not required to disclose — your specific diagnosis or the clinical details of your condition. Your employer has no legal right to demand that information.

What Types of Medical Certificates Can 1GP Issue?

Sick Leave Certificates – Personal Leave from Work If you are unwell and unable to attend work, your 1GP doctor can assess your condition and issue a sick leave certificate where clinically appropriate. Under Australia’s National Employment Standards (NES), employers can request evidence for any absence including a single day and a GP-issued medical certificate is the most widely accepted form of evidence.

1GP can issue single-day and multi-day sick leave certificates. The period certified will reflect your GP’s clinical assessment of the nature and expected duration of your condition.

Carer’s Leave Certificates If you need to take time off work to care for an immediate family member or household member who is unwell, your 1GP doctor can issue a carer’s leave certificate following a clinical assessment of the situation. Under the Fair Work Act 2009, you are entitled to carer’s leave and a doctor-issued certificate confirming the care requirement is accepted as evidence.

Your employer is entitled to know that care was required, but is not entitled to know the specific medical details of the person you are caring for.

School and University Absence Certificates Students who miss classes, examinations, or assessments due to illness may need medical documentation for their school, TAFE, or university. 1GP doctors can issue student absence certificates for educational institutions following a clinical assessment. The certificate will confirm the period of incapacity and your inability to attend your studies.

Centrelink and Other Institutional Purposes Medical certificates may also be required for Centrelink reporting, jury duty exemptions, or other institutional requirements. Please raise your specific needs with your 1GP doctor during your consultation, who will advise whether a standard certificate or an alternative document is appropriate.

Please note: 1GP does not issue Certificates of Capacity for workers’ compensation claims. Workers’ compensation in Queensland requires a Certificate of Capacity issued through WorkCover Queensland not a standard medical certificate. Can a Doctor Backdate a Medical Certificate in Australia?

This is the most common question Australians ask when seeking an online medical certificate  and the rules are specific.

The issue date cannot be backdated. Under the Medical Board of Australia’s Code of Conduct, a doctor must not change the issue date on a certificate to make it appear it was written on an earlier date. The certificate must always show the actual date of the consultation.

However, a GP can certify a prior period of incapacity. If your clinical assessment supports it, your doctor can document that your incapacity commenced before your consultation date. For example, if you were unwell for two days before you were able to see a doctor, your GP may certify that your illness began from the date symptoms started  while the certificate itself shows the actual consultation date as the issue date.

What this means for you in practice:

Your 1GP doctor will assess your situation honestly and issue appropriate documentation. If a prior period of incapacity can be clinically supported based on your history and current assessment, they will certify accordingly.

What if the doctor doesn’t issue a certificate? Your 1GP doctor will always be honest. If a certificate is not clinically appropriate for your situation, they will explain why and advise on your best next steps. Certificates are issued only when the clinical assessment supports them.
